Notice is hereby given that Lion Square Phase II and III Condominium Association has proposed a Fifth Amendment to its Condominium Declaration for Lion Square Condominiums Phase II and III recorded on August 18, 1972, in Book 225, Page 104, at Reception No. 120870, as supplemented and amended (the "Fifth Amendment"), and according to the Condominium Maps for Lion Square Condominiums Phase II and III, recorded on August 18, 1972, in Book 225 at Page 105, and January 26, 1973, in Book 227 at Page 427, and the Condominium Map for Phase III recorded on January 30, 1973, in Book 227 at Page 513, each as recorded in the Eagle County, Colorado real property records (the "Property"). The Fifth Amendment, if approved, would permit a certain expansion of condominium unit(s) within the Property.
All First Mortgagees of any unit(s) within the above-described Property are hereby put on notice that they may consent or deny their consent to the Fifth Amendment within sixty (60) days after the date of this Notice as set forth below. A first mortgagee that does not deliver a negative response within sixty (60) days after the date of this Notice shall be deemed to have approved the Fifth Amendment.
