TOWN OF EAGLE, COLORADO ORDINANCE NO. 21 (Series of 2019) AN ORDINANCE OF THE BOARD OF TRUSTEES OF THE TOWN OF EAGLE, COLORADO AMENDING SECTION 4.04.110 OF THE EAGLE MUNICIPAL CODE TO ALLOW THE PAYMENT OF CASH IN LIEU OF COMPLIANCE WITH THE LOCAL EMPLOYEE RESIDENCE REQUIREMENTS FOR NEW DEVELOPMENT AND TO ALLOW FOR THE PROVISION OF LOCAL EMPLOYEE RESIDENCES OFF-SITE WHEREAS, the Board of Trustees finds that in certain circumstances, it may further the public health, safety and welfare to allow developers to submit cash payments in lieu of satisfaction of the local employee residency requirements set forth in Section 4.04.110 of the Eagle Municipal Code; and WHEREAS, the Board of Trustees also finds that in certain circumstances, it may further the public health, safety and welfare to allow developers to provide local employee residences off-site. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF EAGLE, COLORADO AS FOLLOWS: Section 1. Section 4.04.110.E.3. of the Eagle Municipal Code is hereby amended as follows Section 4.04.110. Inclusionary residential requirements for local employee residency. * * * E. Residential development requirements. * * * 3. Location and character of local employee residences. Local employee residences shall be distributed throughout the proposed development, to the extent possible. Off-site LOCAL EMPLOYEE RESIDENCES housing MAY will not be approved, WITH THE DEVELOPER'S CONSENT IN THE TOWN'S DISCRETION, AT A LOCATION TO BE DETERMINED BY AGREEMENT OF THE TOWN AND THE DEVELOPER. A cash payment in lieu of local employee residences MAY shall not be permitted, WITH THE DEVELOPER'S CONSENT IN THE TOWN'S DISCRETION, IN AN AMOUNT TO BE DETERMINED BY AGREEMENT OF THE TOWN AND THE DEVELOPER. The proposed character and density of local EMPLOYEE RESIDENCES resident housing units shall be compatible with the surrounding land uses and neighborhood character, and suitable for the proposed site. Development and construction of local EMPLOYEE RESIDENCES resident housing units shall comply with all other requirements of this Title. * * * Section 3. Severability. If any article, section, paragraph, sentence, clause, or phrase of this Ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The Board of Trustees hereby declares that it would have passed this Ordinance and each part or parts hereof irrespective of the fact that any one, or part, or parts be declared unconstitutional or invalid. Section 4. Safety. This Ordinance is deemed necessary for the protection of the public health, safety and welfare. Section 5. Effective Date.
